Accounts and Eligibility

• By creating an account, you represent that you are at least 18 years of age.

• You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.

Orders and Subscriptions

• Order Deadlines: All orders must be placed by midnight every Thursday for delivery the following week.

• Subscription Billing: If you choose a subscription plan, you authorize us to charge your payment method on a recurring basis.

• Cancellations: You may pause or cancel your subscription at any time via your account dashboard. However, cancellations must be made before the order deadline to avoid being charged for that week's delivery.

Food Safety and Allergies

• Allergy Disclaimer: Our meals are prepared in a facility that also handles nuts, soy, dairy, wheat, and shellfish. While we take precautions to prevent cross-contamination, we cannot guarantee that any meal is 100% free of allergens.

• Customer Responsibility: It is your responsibility to review the ingredients of each meal. If you have a severe allergy, we recommend that you do not consume our meals.

• Storage and Handling: Once delivered, it is the customer's responsibility to refrigerate meals immediately. Meals should be kept at or below 4°C (40°F) and consumed within "Best By Date" on each package. Fit-n-Fat Catering LLC. is not liable for illness resulting from improper storage or handling after delivery.

Delivery Policy

• Delivery Window: We deliver on [Day(s)] between the hours of [Start Time] and [End Time]. We cannot guarantee a specific delivery minute.

• Unattended Deliveries: If you are not home, our drivers will leave the package at your front door or with your building's concierge.

• Liability for Theft/Damage: We are not responsible for meals that are stolen, damaged by pests, or spoiled due to being left outside for an extended period after delivery.

• Access: You must provide clear delivery instructions (e.g., gate codes). If our driver cannot access your location, the order will be returned to our kitchen, and a refund may not be issued.

Pricing and Payments

• All prices are listed in USD.

• We reserve the right to change our prices at any time. Price changes will be communicated to active subscribers at least 14 days in advance.

• We use third-party processors (e.g., Stripe, Square) to handle payments. By purchasing, you agree to their terms of service as well.

Refunds and Returns

• Due to the perishable nature of our products, we do not accept returns.

• If you are unhappy with the quality of a meal or if an item is missing, please contact us at within 24 hours of delivery. Refunds or credits are issued at our sole discretion.

Limitation of Liability

To the maximum extent permitted by law, Fit-n-Fat Catering LLC. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our service or the consumption of our products.

Governing Law

These terms are governed by the laws of the North Carolina of New Hanover County. Any disputes will be handled in the courts of New Hanover County.
